In establishing this web site, I was urged to provide answers to "commonly asked questions" about the "California Lemon Law," as some other attorneys' web sites do. I decided against it. The problem with simple answers to simple questions (such as, "What makes a vehicle a lemon?") is that the answers often are too simple. Yes, I could tell you that under the "Lemon Law," it is "presumed" that for a "new motor vehicle" a "reasonable" number of attempts to repair "nonconformities" has been made if the same defect (nonconformity) has been brought in for repair four or more times, or that a combination of "nonconformities" has been worked on for 30 or more days, during the first 18,000 miles on the odometer of the vehicle, etc. All of this is correct, but you still might not have a clue as to whether or not you have a strong case.
If you have a new or used car, truck, motor home, or other consumer product, you have attempted to obtain warranty repairs on several occasions for what you believe were important problems, and the product still has one or more of these problems, contact me. I do not believe it should be the consumer's job to try to prejudge whether his or her consumer product "qualifies" under the "Lemon Law." In fact, there is no such thing as "qualifying" because the law requires a combination of things to be taken into consideration, such as
how serious the problem or problems are,
how those problems have affected the particular buyer or lessee of the product,
how difficult the problem may have been to fix,
what the manufacturer or repair facility did to try to fix it,
how "reasonable" the manufacturer and repairing dealership were throughout this process,
and many other factors.
Consumers want to know what their "odds of winning" are before they commit their case to a lawyer. One of my main jobs is to help them make the correct decision.
