THINK OF IT THIS WAY: When you buy a car, you gladly purchase auto insurance-- not just because it's the law, and notbecause you're a bad driver oryou anticipate, expect,or even assume you're going to get into an accident.You do it because ofthat unpredictable factorcalledother people. Other people, who unfortunatelytake their issues, emotions, distractions andquestionable driving skills into the car with them.
SO WHY IS IT that the samesmart, sophisticated folks who gladly buy auto insurance, andwhoalways get the extended warranty, no matter how reliablethe machine or gadget,will balk at the idea of getting a PRENUP --when they know nothing is more unpredictable than human beingsor more prone to go haywire thanhuman relationships??
THIS PUZZLES ME, especially sincewe live in aCOMMUNITY PROPERTY state. So manypeoplefail to consider the ramificationsof this prior to getting married! In a nutshell, itmeansyourspouse willbegin toown50%of everything you accumulate during the marriage --meaning, yourwages, your retirement plan, your business, and the equity in your home -- whether youput their name on the title or not!
AND COURSE YOU'VE HEARD OF ALIMONY,only nowadays it's called "spousal support" and, contrary to traditional belief, it's not what a rich man pays to his ex-wife. It's what the higher earner ex-spouse pays to the lower earnerex-spouse, for approximately 1/2 the length of the marriage. Time for another breath...
FORTUNATELY, A PRENUP allows you toopt-out of most community property laws andlets you-- nota judge -- determine what will happen to your assetsin the event the worse case scenario occurs.I'm talking about both the dreaded "D-words" here: Divorceand Death.And a PRENUP doesn't have to go on forever unless you want it to. AND THERE'S ANOTHER IMPORTANT BENEFIT, almost alwaysoverlooked...I'm talking about talking.
