The Fourth Amendment to the Constitution provides that everyone has the right to privacy and that police may not search a residence without a search warrant. Everyone has the right to prevent police from entering their residence and searching it without a search warrant. The Fifth and Sixth Amendments provide that everyone has the right not to answer any questions from a law enforcement officer without advice from an attorney, and the absolute right to remain silent. This right is as important as the rights to free speech, religion, to bear arms and the right to vote. When an individual is asked a question by a police officer, that person should state: I do not wish to answer any questions, or I want to remain silent.
